Welcome to Ceylon Taxi (also referred to as "we," "us," or "our"). These Terms and Conditions govern your access to and use of the services offered by Ceylon Taxi (a division of Ceylon taxi .lk (pvt) Ltd), whether through the website https://ceylontaxi.lk/ (the "Website"), application software for mobile phones (the "App"), or any interaction with our authorized staff.

By accessing, browsing, or using the Website, the App, or the services provided by Ceylon Taxi staff, you fully accept and agree to be bound by these Terms and Conditions. If you do not accept these Terms and Conditions, you must immediately cease all use of the Website, App, and Ceylon Taxi services.

1. General Conditions and Changes

1.1 Acceptance of Terms

  • Your use of our services is subject exclusively to these Terms and Conditions. You will not use the Website or services for any purpose that is unlawful or prohibited by these Terms.

1.2 Change of Use

  • Ceylon Taxi reserves the right to change, remove (temporarily or permanently) the Website, the App, or any part of the service without notice. We also reserve the right to change these Terms and Conditions at any time. Your continued use of the services following any changes shall be deemed your acceptance of such changes.

1.3 Advice

  • The content on https://ceylontaxi.lk/ does not constitute professional advice and should not be relied upon in making or refraining from making any decision.

2. Relationship Between Driver and Passenger (Intermediary Role)

2.1 Intermediary Service

  • Ceylon Taxi provides a platform that acts solely as an intermediary service to optimize the scheduling and matching of transportation services between independent taxi drivers (the "DRIVER") and passengers (the "PASSENGER" or "User").

2.2 Disclaimer of Liability for Service Provision

  • By accepting the provision of services by the DRIVER, the PASSENGER acknowledges that Ceylon Taxi has no direct association with the DRIVER, serving only to facilitate contact. The user acknowledges and agrees that Ceylon Taxi is not liable for any act or omission committed by any user, including robbery, damage, discussions, effective fulfillment of obligations, or any loss not being for tax purposes.

2.3 User Risk

  • The User acknowledges and agrees that, by registering and using the service, they do so at their total means and exclusive risk. Ceylon Taxi recommends that every transaction is conducted with good sense and caution.

3. Disclaimers and Limitation of Liability

3.1 Availability and System Inconsistency

  • (a) Ceylon Taxi does not guarantee that the system (Website or App) will be available without any interruption and that it will always be error-free. We shall not be liable for damages caused to users due to unavailability or errors.
  • (b) You agree that Ceylon Taxi is not responsible for any damages or losses caused to your computer or mobile device as a result of using the services.
  • (c) Ceylon Taxi is not liable for any error or inconsistency of information with other independent systems, such as GPS, radar, or similar services.

3.2 Indemnification

  • (a) The User agrees to indemnify and hold harmless Ceylon Taxi and its representatives from any claims, suits, losses, liabilities, damages, and expenses, including reasonable attorneys' fees and court costs, for the damage they cause.
  • (b) The User agrees to indemnify and hold harmless Ceylon Taxi and its representatives from any accidental claims or suits that occur due to the DRIVER's negligence or fault. Users accept that Ceylon Taxi acts solely as a scheduling/matching service and is not responsible for issues during the ride, such as accidents, delays, or discomfort.

4. Obligations, Liabilities, and Risks of Passengers

4.1 Voluntary Use

  • The PASSENGER certifies that they use the service of their own free will and choice and recognize and accept as their sole responsibility and risk for using the Website, App, or services received from Ceylon Taxi employees in assisting with a booking.

4.2 Acceptance and Cancellation of Services

  • (a) The DRIVER may accept or deny the service when receiving a ride notification.
  • (b) The PASSENGER may cancel the service for any reason.
  • (c) Both parties recognize that Ceylon Taxi is not liable for any delays, cancellations, failure to cancel, or miscommunication between the passenger and driver, nor for any delay or failure in the delivery of services from the DRIVER.

4.3 Driver Information

  • The PASSENGER acknowledges that the data provided from the DRIVER, such as vehicle model, license plate, full name, profile picture, etc., were provided by the DRIVER themselves or their associated Taxi Company. By accepting the services, the PASSENGER acknowledges that Ceylon Taxi has no involvement in the contractual relationship between the DRIVER and PASSENGER beyond the initial match.

5. Booking and Payment Conditions

5.1 Booking and Cancellation Fees

  • (a) The User can cancel the Hire within 1 hour of the driver accepting the trip without a charge.
  • (b) If the cancellation of a booking is done after 1 hour of the driver accepting the trip, or if the cancellation is made after the Driver's arrival at the requested location, a Cancellation Charge equal to 50% of the agreed booking price will apply.
  • (c) If, for any reason, your driver takes longer than 1.5 hours to get to you, the cancellation charge will be waived.
  • (d) A cancellation fee of 50% of the payment due will always apply if a trip is cancelled after it has begun.
  • (e) If you are not at the pickup location or your driver cannot get in touch with you, the cancellation fee (50%) will apply if the driver is at your pickup location and has waited for over 30 minutes.

5.2 Payment Conditions

  • (a) The User shall pay the taxi fare (as displayed in the meter or the pre-agreed amount with Ceylon Taxi authorized staff), parking charges, and any additional surcharges (where applicable) primarily by Cash.
  • (b) If the user does not have sufficient funds to pay the driver after the hire is completed, the user will be responsible for resolving the payment with the DRIVER or the DRIVER's company, and Ceylon Taxi will be indemnified from any liabilities, losses, or expenses incurred by the driver or Taxi Company.
  • (c) If a credit card or other electronic payment method is offered and used, standard credit card/payment gateway rules and terms will apply.

6. Conduct and Safety Guidelines

6.1 Professionalism and Respect

  • Ceylon Taxi maintains a zero-tolerance policy regarding all forms of discrimination, harassment, or abuse.

6.2 Non-discrimination

  • It is unacceptable to refuse to provide or accept services based on a person's race, religion, national origin, disability, sexual orientation, sex, marital status, gender identity, age, or any other characteristic protected under applicable Sri Lankan law. Violation of this policy can result in permanent loss of access to the Ceylon Taxi platform.

6.3 Safety and Compliance

  • (a) Compliance with the Law: Illegal substances and open containers of alcohol are not permitted in drivers' vehicles unless explicitly allowed by law. Ceylon Taxi prohibits drug or alcohol use by drivers while using the App or serving a taxi service.
  • (b) Passenger Responsibility: As a Passenger, it is your responsibility to abide by the seat belt laws in your state (when required).
  • (c) Driver Discretion: The Driver has the discretion to refuse transportation to a Passenger under the influence of drugs or alcohol. The Driver also has sole discretion to refuse to transport a Passenger with an animal, subject to Sri Lankan laws governing the transportation of riders with disabilities.
  • (d) Lost Items: As a driver-partner, it is your responsibility to make every reasonable effort to return any lost items found in your vehicle. Requiring additional payment to return a lost item is unacceptable and may result in the loss of access to the Ceylon Taxi platform.

7. Intellectual Property and Termination

7.1 Copyright

  • All copyright, trademarks, and all other intellectual property rights in the Website, App, and its content are owned by or licensed to Ceylon Taxi. Accessing the services permits use solely for personal, non-commercial purposes.

7.2 Termination

  • Ceylon Taxi reserves the right to terminate access to the Website or App, or deny access to particular users to any/all of its services, without any prior notice or explanation, in order to protect the interests of Ceylon Taxi and/or other users.

8. Governing Law

  • These Terms and Conditions shall be governed by and construed in accordance with the law of Sri Lanka, and you hereby submit to the exclusive jurisdiction of the Sri Lankan courts.
